In this contribution, Steven Bothof analyses the consequences of the Skanska judgment in a claims procedure for infringement of European competition law. On the basis of case law and literature, the author concludes that the effect of the concept of enterprise, as a result of the Skanska judgment, can offer the injured party a significant extension of liability possibilities.
